pct national phase

Postby danbrenreen » 21 Oct 2008, 11:05

Hi everyone
I am in a tight spot with my pct application right now. The 30 month deadline runs out on nov. 15 2008, but I have very little money to file in any of the designated states. Does anyone know if I need a attorney to file in the usa or can I file myself to cut costs. Another problem is the claims need alot of amending for the us patent office and I wonder if I could just file a provisional patent, with the draft I have right now and try to get funding somewhere within the year and file an amended application, or what is possible. it would be great if I could just pay the filing fees for now, and address the other problems later, Thanks for reading

Hi

The following link will take you to the relevant part of the PCT Applicant's guide giving all the required information for entry into the national phase before the USPTO.

http://www.wipo.int/pct/guide/en/gdvol2/annexes/us.pdf

You will see that it is not essential to appoint a representative, although it is advisable.

Hope this helps.

Ian

Thanks for the help so far now I am trying to respond to the pct first communication,
I have no money but I got to be able to do this somehow, what happens in the pct office if your reponse to need for amendments is not fully to their satisfaction, are they helpful in there?

thanks Ian for the reply, as regards having no need for an agent I know you do not need an agent to have usa as one of your designated countries under the pct system, but i was sure that to prosecute the patent there in the usa, you have to have an agent in usa if you are not a us citizen, I must google it and try to find out if i need an agent to finish my patent prosecution there, i have no funds so if i could, it would be helpful, any help to the destitute lone inventors, is Gods work I assure you so
Thanks for your reply!!
